Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the ResumePolish AI mobile application (the "Service") operated by Roxy Apps, LLC ("us," "we," or "our").

Important Notice: ResumePolish AI helps you create professional resumes and cover letters. The AI-generated content is provided as a tool to assist with resume enhancement and should be reviewed and customized by you before use.

1. Agreement to Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

ResumePolish AI is a mobile application that provides AI-powered resume enhancement, formatting, and cover letter generation services. The Service allows users to:

Input and upload their resume content
Receive AI-generated resume enhancements and formatting
View professionally formatted resumes
Chat with an AI career assistant
Access their resume history and generated cover letters

3. Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that:

You are at least 13 years old
You have the legal capacity to enter into these Terms
You will comply with all applicable laws and regulations
All information you provide is accurate and truthful

If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

4. User Accounts

4.1 Account Creation

To use certain features of the Service, you must create an account using Apple ID authentication. You agree to:

Provide accurate, current, and complete information
Maintain and update your information as necessary
Maintain the security of your account credentials
Accept responsibility for all activities under your account

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. User Content

5.1 Your Content

You retain ownership of any content you submit, post, or display on or through the Service, including resume content, cover letters, and related data ("User Content").

5.2 License to Use Your Content

By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to:

Use, reproduce, modify, adapt, publish, translate, and distribute your User Content
Process your User Content using AI technology to enhance resumes and generate cover letters
Store and maintain your User Content on our servers

This license is necessary for us to provide the Service, including AI processing and enhancement of your resume content.

5.3 Content Restrictions

You agree not to submit User Content that:

Is illegal, harmful, threatening, abusive, or discriminatory
Violates any third-party rights, including intellectual property rights
Contains malware, viruses, or other harmful code
Is spam, unsolicited, or promotional in nature
Violates any applicable laws or regulations

6. Intellectual Property Rights

6.1 Our Rights

The Service and its original content, features, and functionality are owned by Roxy Apps, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 AI-Generated Content

AI-generated interpretations, analyses, and visualizations are provided for informational and entertainment purposes only. We do not claim ownership of AI-generated content, but you may not reproduce, distribute, or use such content for commercial purposes without our permission.

7. In-App Purchases and Subscriptions

7.1 Purchases

The Service may offer in-app purchases and subscription services. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.

7.2 Subscriptions

If you purchase a subscription:

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions through your Apple App Store account settings
No refunds will be provided for unused portions of a subscription period

7.3 Refunds

Refund requests must be submitted through the Apple App Store in accordance with Apple's refund policy. We do not process refunds directly.

8. Prohibited Uses

You agree not to use the Service:

For any unlawful purpose or to solicit others to perform unlawful acts
To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
To infringe upon or violate our intellectual property rights or the intellectual property rights of others
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
To submit false or misleading information
To upload or transmit viruses or any other type of malicious code
To collect or track the personal information of others
To spam, phish, pharm, pretext, spider, crawl, or scrape
For any obscene or immoral purpose
To interfere with or circumvent the security features of the Service

9. Service Availability

We reserve the right to:

Modify, suspend, or discontinue the Service at any time
Restrict access to the Service for any reason
Change, suspend, or discontinue any feature or functionality
Perform maintenance and updates that may temporarily interrupt service

We do not guarantee that the Service will be available at all times or that it will be error-free.

10. Disclaimers

10.1 AI-Generated Content

The AI-generated resume enhancements, formatting, and cover letters are provided as tools to assist you in creating professional documents. They are not intended to be:

Guaranteed to pass ATS systems or secure employment
Substitutes for professional career counseling
Perfect or error-free without your review

You should review and customize all AI-generated content before using it for job applications.

10.2 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROXY APPS, LLC, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY.

12. Indemnification

You agree to defend, indemnify, and hold harmless Roxy Apps, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

Your access to or use of the Service
Your violation of these Terms
Your violation of any third-party right, including any intellectual property or privacy right
Your User Content

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete the application from your device.

All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Delaware, United States.

You waive any right to a jury trial and agree to resolve disputes on an individual basis, not as part of a class action.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements.
